Trucker Blames Parking Shortage For I-77 Crash

by Jana Ritter - Published: 5/11/2016

The truck parking shortage has been an on-going issue for quite some time and even though Jason’s law was passed in 2013, specifically to give truck drivers better access to safe rest areas, the problem only seems to be getting worse.

The most recent incident to bring this problem back into the light occurred around 2 a.m. last Friday morning in North Carolina. Last August, "Jason's Law Truck Parking Survey" found the state to already be one of the worst places to find legal rest stops and the problem has become that much worse since Gov. Pat McCrory implemented a crackdown specifically targeting truck drivers last year. The state justified the “no-parking” campaign with crash statistics that many say exaggerated the relation between parked vehicles and fatal accidents. Nevertheless, NC Highway Patrol have been relentlessly cracking down on truckers parking to rest beside exit ramps, specifically I-77 where there is the highest documented shortage of legal rest spots.

On Friday, Utah truck driver Glen Hamblin was driving through North Carolina I-77 and although he still hadn’t reached his HOS limit and wasn’t far from his destination, he was struggling to stay awake in the wee morning hours. Sometimes your body speaks louder than all the Federal regulations, state laws and job expectations and Hamblin knew he was tired and needed to rest. “E-logs do not work,” Hamblin said. “The company wants you to get your miles in. So when the e-log says you can drive, then you drive. Maybe your body doesn’t say it’s time to drive. With electronic logs, you drive tired.” He was hauling 50,000 pounds of potatoes he had picked up in Michigan the day before and was delivering them to the Frito-Lay plant in Charlotte, just past the South Carolina state line. Sleep kept trying to set in and he continued fighting if off as he rolled down I-77, searching for a safe, legal place to stop.

                                                         I-77 crash

“Every exit, I was looking and hoping to find a sign that said ‘Rest Area,’ ” said Hamblin. Unfamiliar with the area, he didn’t realize that they simply didn’t exist and he didn’t want to pull over on the shoulder of an exit ramp knowing he couldn’t afford the typically $600 ticket. Hamblin continued driving, searching and fighting off sleep for about half an hour, until Mother Nature finally won the battle. “I dozed off for a second and woke up just in time to see the cement barrier in front of my truck,” he recalled. Hamblin crashed into the barrier near Exit 9 and the impact sent the 50,000 pounds of potatoes hurling all over the road and his truck to overturn and the engine to fly out, erupting into flames. The truck driver has no idea how he survived the incident but is thankful he only suffered minor scrapes and bruises.

However, he now regrets his decision for obeying the laws because it cost him his livelihood instead of a parking ticket. “In hindsight, I should have pulled off,” Hamblin said. “A ticket would obviously be better than a wrecked vehicle. It cost me my whole rig, and my way of making a livelihood.” Hamblin is speaking publicly about the incident to try and implore upon the industry and regulators the urgent need to solve the parking shortage. “There’s not enough rest areas. Even if you do find a truck stop or a rest area, they’re full, and you still have to drive tired.”

All states need to do like Wyoming build huge truck only parking every 50 to 100 Mls apart even in the northeast that would help a lot and it would put a lot a people to work building them easy fix but they'll never do that it might just help

theres only 2 rest areas along 77 and both are dinky and 2 truck stops and neither have any room after 3 pm

The parking problem will continue to get worse with the implementation of E Logs, and the fact that every new Pilot or Love's TS only make room fir about 3 dozen parking spaces. It seems they don't want trucks hanging around not spending money on their over priced goods and services.

Just another dumbass blaming elogs. There was parking issues way before elogs were even thought of. I love my elogs i drive 12hrs a day work 15hrs a day and still have a place to park at the truck stops all while on elogs. Your point is invalid.
Richard A Grambort
Richard A Grambort
If you are driving 12 hours a day, you are Canadian. Which makes YOUR point invalid. Here in the states it's a whole different story.

BS......if you get tired STOP....... ELogs or not.......if your company has a problem with that.....oh well. Tell them the truck will get there when it turns into the customers driveway. I'm getting sick of all these drivers saying they are forced to drive tired because of eLogs......nobody is holding a gun to your head forcing you to drive. YOU are the one in control.....not your dispatcher. YES.....I am on eLogs......YES I am a company driver with the same company for 20 years.

I drove for Gordon, IN there orientation "SAFETY " sure was preached, but once You get out on the road that word SAFETY doesn't exist. As far as I'm concerned all companies are the same just with a different name on the side of the truck -trailer . I've been off the road OTR for three years & the first year I made more & being home every nite.

All companies ARE NOT the same. First thing is to STAY AWAY from the mega companies. Second thing is to NEVER WORK FOR MILEAGE PAY.
Dan Guise

Daniel Kettlewell never work for mileage really you obviously are a union driver , why should a small company pay you for doing nothing , isnt it common sense to pay you for work done
Richard A Grambort
Richard A Grambort
When you get tired, pull into a truck stop to rest, only to find it full with half the spots taken by dropped trailers and empty bobtails, tell me Einstein, what do you propose you do? I suppose you can park at the fuel island like every other fat lazy driver that us to lazy to walk. Until Truck stops go back to serving the trucker, and stop catering to the tourist, it will only get worse.

YES......rates are increasing.....they have been steadily for SEVERAL years. Why should you bust your ass to run 3000-3500 miles a week on mileage pay when you can make the same money working percentage and only drive 2000 miles a week??? Work Smart.....not Hard

Even the carrier i drive for will not allow me to pull to the side of an exit. If it is not "truck parking", I'm a "sitting duck" and will lose my contract. This is a state issue. We are looked down upon and it's only getting worse. Thank all the drivers dumping piss jugs and their trash in the parking lots for us being less and less welcomed, and less safe spaces to park.

I have always refused to park on ramps myself from a safety standpoint.......to easy for someone to run into you. Alot of our customers we can park at for the night.....safer than truckstops. I'm spending the night at one tonight.....first in line for in the morning....LOL

I think it's funny that it's this obvious that the problem exists yet they are not doing anything to resolve the issue. Oh but let's mandate this & mandate that if you fuck up I'm going to penalize you. That's it fuck me some more for trying to make a living if I'm not getting fucked by the government I'm getting fucked by an employer. I'm not even sure wtf I do this for anymore oh wait now I remember it's cause minimum wage isn't $15/hr yet if it was I'd probably just go flip burgers lol & before any of you wise asses want to start telling me what I don't know about the shit I've been out here for awhile I've done logging I've done cattle flatbed crude oil oversized van reefer & oversized trucking is a joke and about 85% of you don't know what the fuck your doing in the first place & I'm not talking about the people on this Facebook post I actually agree with a lot of your comments I didn't comment to argue with anyone I'm talking about the industry as a whole I watch it on a daily basis because yes I do care it's my life to & I have plans on making it home just like everyone else so I am paying attention this job isn't for everyone & it can hurt you in a heartbeat doesn't even have to be your fault keep em upright and stay safe out there 😎

The other BS about parking, is the reserve parking. It's about $12 a space, and a lot of truck stops are taking half the parking up for the reserve parking. Over 50 spots reserved for pay parking at the TA in Denton, TX. Yet the restrooms are dirty. Drivers spend enough in the Truck stops. Should have to pay to park. It should be 1st come 1st trucks in get the parking spot.
Brandon Thomas Fetters
Brandon Thomas Fetters
Then it would go back to hardly never find a spot in there. 2pm it usually would be packed. I do a lot of trips into Denton. I have no issue paying it so I know I have a spot to park
Danielle Lee Freshour
Danielle Lee Freshour
Then try better trip planning! When you get there at 12noon and no spots to park in or do laundry and stick around for a few hours. If a truck stop takes up half it's parking for reserve paid parking. Then they should just make to whole parking lot paid parking. I drove for 16 years, was out of the truck 3 years. Trucks stops were first come first serve just like they should be now. You shouldn't have to spend $300 plus a month just to park a truck and take your break. Heck 10 years ago if you were parked by 8pm you usually never had a problem. Now you have to be parked by 2pm. That's BS. Also the closer the TS is to a big city, the more spaces taken up for reserve. That is also BS.
Danielle Lee Freshour
Danielle Lee Freshour
If the trucks stops are making a few extra a night in parking. They should clean the place up better. That place used to be clean in Denton. It's really gone down hill.
Josh Cronch
Josh Cronch
I'm so damn tired of seeing this "try better trip planning" BULLSHIT!!! you can plan what you WANT to accomplish and where you WANT to be at the end of the day but that's it!! You can't plan for unusually long delays to load or unload, u cant plan for accidents, you can't plan for 5 miles of traffic going into a construction zone!
Lee Wade

The laws applies to paper and ELDs the same. The problem are drivers that allow others, dispatch, shippers, receivers, and other drivers how to drive their trucks. To say elogs is the problem and that paper logs are easier to falsify to run longer hours is telling the safety advocates that elogs are working by stopping drivers from falsifying paper logs. Yes, most trucking companies are the same when it comes to pay and working conditions because they know most drivers are afraid to stand up to them. You all talk like men but are a bunch patsy asses.
Beverly Levesque
Beverly Levesque
for starters some of these drivers should learn to park between the lines every truck stop has wasted parking spaces because of lazy people not parking straight between the lines and these people are supposed to be professional drivers have you seen how they park lately and it's getting worse and it's not just new drivers either
Gentry Martin

Been running ELOGS for almost 5yrs now and u gotta set yourself on schedule routine I run all out on my hrs day, nite, evening shifts don't matter I average 2700-3200 week it's the driver tht needs to learn how to manage the ELOGS. Now I agree there isn't enough parking out here but if u pre plan ur stops accordingly to save on ur time itta work out! My only complaint bout ELOGS is stuck n traffic and the B.S. at the shippers and reciever run u outta time n tht case with my company we have wat u call OFF-DUTY DRIVE we can use tht to get to a safe haven..

Well yea thts just something nobody predicts! But u still plan ur shit everyday least I do. These drivers thts still on paper and goes to ELOGS is n for wake up call no more fuckin around log wat u want when u want..

Gentry Martin I've run both I kinda like both what a lot of these drivers don't understand is it really doesn't matter these scales got your number open or closed ok so I'm back on paper for now and it makes a tiny difference here & there but I am still bound by the 14 hour laws and the minute I cross a scale or get fuel guess what here I am over here lol

How about if we just do our job like professionals every time & maybe they will quit trying to cram shit up our ass to try to get us to quit fucking up?

Long Island Expressway I-495 NY is closing its already overloaded truck parking areas off to truck parking. Any roads on Long Island with wide shoulder lanes are now used as bike lanes and therefore any parked trucks in these area will be hit with high tickets and fees. Most if not all shopping areas are also off limited to truck parking but during daytime ours are host to DOT inspectors.

James McCreight

See. The ATA, aka American Trucking Association is NOT a government agency. It is an organization, just like OOIDA. (You should be a member by the looks of it). And if someone, such as yourself, who claims to have studied "electronics engineering" (which isn't even a thing) you'd know this. (Try electrical engineering maybe). The shortage is very real at 25k drivers, maybe more, daily for at least the next 5years. This may or may not include international drivers from Canada. With freight projections, we're looking at an increase of 29% over the next decade. So if you wanna play games instead of researching information about YOUR career choice, by all means, go ahead. Until then old man, keep your dick holster shut
Alton Box
Alton Box
James McCreight ok so I'm not agreeing or disagreeing because I haven't really looked at the statistics but if that is true than why aren't the rates better? Why isn't it profitable for me to just buy my own truck? I might add I'm not a rookie driver I've owned my own truck and lost my ass do to lack of experience live & learn I say it's the brokers and mega carriers that are fucking everyone but how are they doing it with a shortage of drivers?
Derrick Silvester

All shippers and receivers need to be able to,accommodate trucks. Municipalities shouldn't let the people block having truck stops built in their towns. At night, Vacant mall lots should be open to trucks from closing time to opening time.... there's so much that needs to be done to accommodate drivers.
