Boxer Battles Bill Measure That "Takes Advantage of Truck Drivers"

On Thursday, California Sen. Barbara Boxer (D) took the floor to block a measure cited in an aviation reform bill that would pre-empt individual states from imposing their own rules on meal and rest breaks for truck drivers. She termed the language in the bill as “a threat to highway safety and an effort by big trucking firms to take economic advantage of drivers by keeping them behind the wheel for as long as possible.”

The measure had actually passed the House Transportation and Infrastructure Committee earlier this month, but during Thursday’s press conference Boxer said it has no place in any bill put before Congress and that she wrote Sen. John Thune (R-S.D.), who oversees aviation legislation, and Sen. Bill Nelson (D-Fla.), the committee's ranking member, telling them to block the provision from being included in the Senate's version of legislation. The legislation is part of an overall reauthorization of funding for the Federal Aviation Administration. The House measure in question is also known as "Section 611" and would grant federal pre-emption power over what remains of state economic regulations of interstate trucking services. The measure was initially excluded from the December federal transport-spending bill set in response to the 2014 ruling by the 9th U.S. Circuit Court of Appeals upholding California's driver meal and rest time rules as not subject to federal pre-emption. The reasoning for the exception was because California policies did not bind motor carriers to specific rates, routes, and services, and therefore did not interfere with competitive market forces. When the U.S. Supreme Court chose not to hear an appeal of the ruling, advocates of the measure lobbied to include it in the aviation bill.

Not surprisingly, there are many trucking industry groups such as Teamsters, independent owner-operator drivers, and safety groups that also oppose the measure. They say not only does it prevents states from assuring that all drivers get paid for their break times, but also the non-driving part of their jobs such as the time spent loading and unloading their trucks. Boxer also adds that such drivers concerned about not being paid for non-driving time will feel pressured to spend more time behind the wheel and likely run further risk of dangerous, fatigued driving.

However, there are also industry representatives that are in support of the measure such as the ATA, which says the language clarifies the general intent for the industry to operate under one set of federal rules including driver break requirements. “A single set of consistent and fair regulations is essential to the trucking industry,” said ATA President and CEO Bill Graves. “Language currently being discussed by Congressional leaders would ensure that drivers operate under a consistent set of break rules, whether that driver is delivering a trailer full of water to Flint, Mich., or picking up a load of avocados in Temecula, California.”

How about some attention to the trucking industry period. The freight rates are beyond stupid. Brokers are gouging customers and stealing money meant for the trucks to operate and pay the drivers. Large fleets are losing drivers because of pay and working conditions. There is no place to park at night. Start up companies are pulling freight for chump change and hire drivers from overseas who cant drive understand english enough and break hours of service rules. Its all bullshit the industry is at a breaking point. People wonder why there are these multiple chain reaction disasters on the interstate its because of poorly trained drivers who dont know any better..

I recall driving for one company, I'm going to mention what company but any how one of there O/O Owner Operator trucks was getting out standing miles per week. We'll to make a long storey short they said they needed to stop by a terminal and get a service. They did ,the service guy pulls truck in bay to do service &grabs a creeper to grease it and sees this stuff dripping of the drive line ,stinky stuff.They cut a hole in the floor pan in the sleeper right over the drive line and that's where they went potty. To top it off there was three drivers in the truck, one of the three did not have a CDL , all three were Muslim. I heard that the company fired them ...

there is too much over reach in DC on individual State's rights, but the trucking industry operates nationwide, in the 48 Continuous States and DC we all need to operate under the same rules and regs if it's all about safety. The ATA is for the mega companies not us. we should just go back to the pre-July 2013 HOS rules and leave it be. we've all lost earning potential and work due to these damn politicians and lobbiest who never did a day on the road. a 14 hr day with 11 drive and get out and kick a freakin tire once in awhile , the provisions didn't help saftey or drivers only gave the mega companies another way to keep their precious revolving door open.

We have 2 problems here, first we have the Republic of California dictating policy for the rest of us. If every CDL holder, transportation, construction, everything, refused to drive for one week in August, the State of California would be in shambles. Second, no body should be allowed to make any form of bill or measure involving trucking unless they have either ridden or driven on at least two, 2-3 week runs to see what we deal with daily. This could make our jobs more lucrative and pleasant. I love my job and I'm sick & tired of these pencil pushing nit-wits screwing up my livelihood.

The way I see it breaks need to be mandatory. You should be able to run 10hours a day with a mandatory 1hr break with two 15 minute breaks in between. And raise the speed limits on the trucks to 72 MPH
