The incident occurred on the 4700 block of E. 12th Street where Jimmy Martinez was already parked in his RV with his dog Chata - a 4-year-old Labrador and pit-bull mix. At about 12:43 pm a truck driver showed up and was angry about the spot being taken up. He demanded Martinez move his vehicle and Martinez said the told the man he would move but it would take a few minutes because he needed to charge his battery. Apparently it wasn’t the right answer because the argument continued to escalate, prompting the truck driver to retrieve a gun from his rig.
“The truck driver just got really pissed off and said ‘Let me show you what truckers do to motherf—–s. He went to his truck and pulled out a Glock 40 caliber,” Martinez told CBS News.
According to Martinez, the suspect then pistol whipped on the side of the head, which immediately left a large gash. Then he started opening fire at Martinez and the RV. At that point Chata came running out to defend her owner and the gunman started firing at the dog instead. She was struck by two bullets in the face -one entered through her mouth and exited through her jaw and neck. Fortunately Martinez was able to escape back inside the RV and Chata was able to quickly slip back in with him as the suspect continued to open fire. Martinez said it seemed like forever until finally the firing stopped and the gunman fled. At that point he realized he had been struck in the arm, shattering many bones and leaving him unable to continue his work as a mechanic.
But Martinez was more concerned about Chata who had got the brunt of shooter’s rage. “She was bleeding real bad but she wasn’t crying. She was more concerned about me then herself. She was nuzzling me and she never let up,” he said. “If it wasn’t for the dog, I wouldn’t be here. I would not be here at all.” Although Chata survived emergency surgery, doctors say her recovery still depends on further surgeries to remove the bullet fragments in her jaw. Without the additional surgeries her ability to eat and drink will be compromised and she would have to be euthanized.
“If it wasn’t for Chata, I wouldn’t be standing here talking to you. I would be planning a funeral for my brother. So she saved him, so we have to save her,” said Martinez’s sister Diane. She started a gofundme site to help raise money for Chata’s medical bills. She also had a message for the shooter who is still at large. “I pray for you because that’s not a human being. I don’t see how you can sleep after what you did. This is the type of guy that doesn’t need to be on the streets.”
Police and Crime Stoppers of Oakland are offering up to $7,500 in reward money for information leading to the arrest of the gunman. Anyone with information may call police at 510-238-3426 or Crime Stoppers at 510-777-8572.
There was a time, long ago, when I started my career as a truck driver (1980's), you could count on truckers to be heroes, helping for no reason, assisting motorists without reward. I believe the root problem is trucking schools are dropping the ball, pushing drivers out onto our highways with little to no real world training.

The trucking schools can't fix this. This just reflects the lack of character amongst American society. And that is a tragedy that is way greater than the shooting.
I'm confused...the truck stop is full and no one heard gun shots, no one called the police, no one saw the truck he was driving, this is a big ass truck with a trailer... really. This don't sound crazy to you...I mean over 10 shots and no one saw it... really.

I don't think so most of us truck driver are always calm I know there are times when we stress out driving all day and come to places where there is no spot to park still we try to keep it cool that truck driver lost it went way to far he could just waited for a bit and all this would of been avoided

The only state that doesn't have reciprocal carry law is NM. This from a police officer who has trained and/or driven through 30+ states while carrying (not me).

How beautuful, this is a picture of my dog who passed last year. I still cry for him. He was my friend and comforter. I loved this dog more than anything. I hope this Truck Drivers dog pulls through. Its the hardest thing to lose a friend and companion who shows unconditional love

Oh my God, I actually cried reading this. I've been a trucker for almost 19 years and believe me, please believe me, he is not a trucker. I've never met a trucker that would do something so deplorable, so disgusting, to another human being. I hope they find him and I hope he spends the rest of his life behind bars. I am so sorry that this happened to you and to your beloved Chata. I wish you both a very speedy recovery and I'll keep you both in my prayers.
I am a trucker and have experienced some irate people,one right in the middle of the IS he stopped and wanted to cus me out ,I could see the rage in his eyes--he was crazy and I could have drew down on him, but didnot, I picked up the phone and dialed 911 when he saw that I had the phone in my hand he excited the sene very quickly. There r very bad apples out there and u have to be very wary of them and coutinualy look behind ur back!! Truckers r good people who do a hard job some r bad but the major mageority of them I would trust with my life !!

I aggree, I drove a long time, this is a picture of my dog Sam who passed a few months ago. He was my friend and companion. He showed unconditional love. I miss him everyday and cry a lot im not ashamed to say. I hope this Drivers dog come out ok I pray for him.
